Licence Shield About

Case Study: How How We Avoided 6 points and a £1,000 fine...within 48 hours!

When a vehicle is caught speeding the police send a request to name the driver of the vehicle in question. This request is always sent to the registered owner. Our client (the registered owner) responded to this request (to name the driver) by simply stating that they did not know who was driving at the time of the alleged offence...

The police subsequently accused our client of failure to name the driver - an offence that carries 6 points and a £1,000 fine. Upon facing this draconian penalty, our client felt they needed serious help and contacted us. The police at this point were ready to convict our client and throw the book at them...they were seriously facing a £1,000 fine and 6 points.

Our expert lawyers jumped on their case immediately as time was of the essence. We tailored a defence specific to their circumstances. We:

Contacted the police outlining both faults in police procedure and their paper work.

Presented a detailed argument as to why our client was unable to name the driver. Detailing a blow by blow account and proving beyond all reasonable doubt that due effort and diligence had been applied.

Put forward a comprehensive report on our clients circumstances and how the prosecution (if they were to continue and convict) would cause exceptional and unfair hardship. We also argued that protracted legal battles were unfair and a swift resolution (by dropping their case) was in order.

Questioned whether this offence was in the public interest and gave specific case law examples of similar cases.

The police subsequently dropped all charges against our client within 48 hrs!

I was initially very upset and concerned that I was going to be punished for genuinely not being able to name the driver, but when I spoke to Motoring First’s legal team they acted quickly and I am extremely grateful. I was surprised how quickly they got the case dropped! Licence Shield really does give me piece of mind that I will be fairly treated by the police - Ted (Our Client).
